Sportswear giant Adidas has lost a legal battle over a perceived infringement of its iconic three-stripe trademark. Thom Browne, an American premium fashion label that uses a four-stripe trademark on its clothing, is the target of an Adidas complaint. Adidas filed a lawsuit, claiming that the four stripes were too similar to its own three stripes. It attempted to claim more than $7.8 million in damages. Thom Browne, however, won the case thanks to a jury's verdict in a Manhattan court. It stated that the four stripes did not violate Adidas' brand or logo. The jury concluded that since consumers could tell the difference between three and four parallel stripes, they were unlikely to mix up the two brands.
The fashion label Thom Browne was established in New York City in 2001. It works with many of the biggest brands in the industry of luxury clothes and caters to the high-end fashion market. The company gained notoriety by creating a scarf for Joe Biden's "Believe in Better" clothing line in 2020. The conflict with Adidas began sixteen years ago. In 2007, Browne created a jacket with a three-stripe pattern. After Adidas objected, Browne changed to a four-stripe design. Because the two businesses "operate in different markets, serve different consumers, and offer their products at strikingly different prices," according to Thom Browne, there was unlikely to be any mistake between the two designs.
